May 2009: Newt Called for Individual Health Insurance Mandate ...

Via Hot Air, Verum Serum unearthed this clip of a May 2009 conference call with Newt Gingrich. The subject was health care, and Newt clearly called for an individual health insurance mandate on a national level. This wasn?t over a decade ago, which Newt would like you to believe. He proposed that the only way to avoid purchasing health insurance was to post a large bond that would be unaffordable for most middle class Americans. It wasn?t until he decided to run for president that he changed his tune. He also had positive things to say about the drafting of Obamacare. As Morgen at VS points out, this was before the health care fight really turned ugly, but it?s still damaging to Newt?s credibility on the issue. He actually said the process was better than it was in 1993.

Morgen summed it up pretty well.

Well, here you have it: not only has Gingrich been a long-standing proponent of a federal health insurance mandate, he clearly and unequivocally called for it as part of the White House health reform initiative in May 2009. Mission accomplished then.

There is something else worth noting in this clip. Not only did Gingrich make the ?conservative? argument for the mandate in dealing with the free rider problem, he also advanced a favorite argument of the left. Which is that the only way insurers could be required to offer coverage to everyone regardless of their health status (?must issue?), was to require everyone to carry insurance. This was ultimately the argument which convinced none other than Barack Obama, who remember, opposed an individual mandate during the Democrat primary campaign in 2008.

The entire presentation can be heard here, although it takes a little while to load.

Probe of NYPD boss' son puts DA in spotlight, too (AP)

NEW YORK ? While the city's powerful police commissioner faced questions Friday about a rape allegation against his TV-anchor son, the probe has also put the district attorney in a delicate position.

The Manhattan DA who brought and dropped sex charges against Dominique Strauss-Kahn is now in the thick of another sensitive, highly scrutinized sex-attack investigation, this one involving a relative of a key law enforcement ally. But the new inquiry presents major differences; for one, there have been no arrests.

The commissioner refused to discuss the investigation as he faced the media Friday for the first time since reports surfaced that a woman had accused his son Greg of rape.

"I'm not going to ... with all due respect, answer any questions on this matter," Kelly said at a news conference at police headquarters, saying questions should be addressed to the DA's office. Police have turned the matter over to prosecutors because of the potential conflict of interest in investigating one of the commissioner's sons.

Greg Kelly, the 43-year-old co-host of the local TV morning show "Good Day New York," has vehemently denied doing anything wrong in the episode.

The allegation presents a new high-profile sex-crime probe less than six months after the attempted rape charge against the former International Monetary Fund leader collapsed amid doubt about his accuser's trustworthiness in the biggest case of Cyrus R. Vance Jr.'s two years as DA.

Indeed, the Strauss-Kahn case still looms large enough that Greg Kelly himself queried Vance on-air about it just this Monday. But the two matters are far from parallel, legal experts say.

The DA's office stayed silent about the matter Friday as Mayor Michael Bloomberg praised how Kelly and the police department addressed it and called Vance "a tough, smart guy" who could handle the hot seat.

For a DA in one of the most prominent prosecutor's jobs in the country, "there's always going to be high-profile, complicated cases. There's always going to be second-guessing. He's tough enough to focus on the job," Bloomberg said on "The John Gambling Show with Mayor Mike" on WOR-AM radio.

The woman told police Tuesday she met Greg Kelly for drinks on Oct. 8, they went to her lower Manhattan law office and he assaulted her while she wasn't capable of consenting to sex, a person familiar with the investigation has said.

The woman and Kelly stayed in contact afterward, the person said.

She said she became pregnant from the encounter and had an abortion, according to a law enforcement official. Neither the person nor the official was authorized to speak publicly, and they talked to The Associated Press on condition of anonymity.

At some point, the woman's boyfriend confronted the commissioner in person at a public event, saying Greg Kelly had ruined his girlfriend's life but declining to elaborate on the spot when asked what he meant, according to police spokesman Paul Browne. Browne said the commissioner suggested the boyfriend send him a letter, but the man apparently never did.

Greg Kelly's lawyer, Andrew Lankler, has said the investigation "will prove Mr. Kelly's innocence."

Kelly took time off starting Thursday from his show on local Fox affiliate WNYW-TV, the station said.

Three days before, Vance appeared on the program to talk about the problem of elder abuse. Kelly also questioned him about the case against Strauss-Kahn, who was charged in May with making a hotel maid perform oral sex. The onetime French presidential hopeful has said the encounter was "inappropriate" but not violent.

Prosecutors said they dropped the case in August because the woman had undercut her credibility by lying about her background and changing her account of her actions right after the alleged attack. She says she was truthful about the encounter and is pursuing her claims in a lawsuit.

Some have questioned whether "if she were a more prominent citizen, member of the community, she would not have been subjected to that kind of interrogation," Kelly noted to Vance on the show.

Vance called that a "misimpression and incorrect assessment of the case" and said his office looks at each case carefully.

Even from the few details known so far, the investigation into Kelly has some sharp distinctions from the Strauss-Kahn case, but it may pose just as significant challenges, experts said.

Strauss-Kahn's accuser swiftly reported the alleged attack, prompting an arrest within hours and allowing investigators to gather a sample of the then-International Monetary Fund leader's semen on the woman's work clothes. It's unclear whether they will have any forensic evidence to work with in the investigation into Kelly, or whether his accuser sought medical attention.

Concerned that Strauss-Kahn might flee overseas, prosecutors persuaded a judge initially to hold him without bail. Although Strauss-Kahn was released to house arrest days later, his jailing had forced prosecutors to obtain an indictment because of legal time limits on holding someone without one. The DA's office later faced some criticism that it had rushed to indict before completely investigating, though some legal observers said Strauss-Kahn's foreign ties left prosecutors no choice.

Kelly, on the other hand, hasn't been charged with any crime, so there's no legal deadline looming over prosecutors' investigation.

"There are very significant differences, and that's a justification for (prosecutors) to be more deliberate in how they go about it," said Fordham Law School professor James A. Cohen.

The investigation involves not only the public attention that surrounds any well-connected target, but the added complication of investigating a son of an official who works closely with the DA, noted Pace Law School professor Bennett L. Gershman. He worked in the 1970s for a special state prosecutor appointed to investigate corruption in the criminal justice system.

While the DAs sometimes investigate police officers or their relatives, "this is a special case," Gershman said. "It puts him in a very difficult position."

Indeed, police were defendants in one of Vance's other most prominent and difficult cases: last year's trial of two officers accused of raping a drunken woman they were called to help get home.

The officers were convicted of official misconduct for returning to her apartment without reporting where they were. But they were acquitted of all other charges in a verdict that came less than two weeks after Strauss-Kahn's arrest.

The DA's office has since logged a number of wins in noted sex-crime cases, including a 428-year sentence for a man convicted of sexually attacking five women and a rape conviction and 20-year sentence for a man accused of holding himself out as a worldly French-language journalist to approach women.

While the Kelly investigation may put the DA under pressure again, "it's only comparable to the (Strauss-Kahn and two officers') cases in that it's high-profile," said Linda Fairstein, a former longtime chief sex-crimes prosecutor in Manhattan. "...It'll get done like any other case."

President Tyler's grandkids still alive (Politico)

John Tyler became the 10th president of the United States in 1841 ? and today - incredibly - he still has two living grandchildren.

Tyler, who lived from 1790-1862, had 15 children during his lifetime, making him the most prolific president. One of his children, Lyon Gardiner Tyler, born in 1853, fathered Lyon Gardiner Tyler, Jr. in 1924 and Harrison Ruffin Tyler in 1928, according to Sherwood Forest Plantation Foundation, the home of President Tyler.

Both men ? Tyler?s grandchildren ?are still alive.

Tyler was William Henry Harrison?s Whig running mate in the 1840 election, which spawned one of the most famous campaign slogans in American history, ?Tippecanoe and Tyler too.? On his 32nd day in office, Harrison died of complications from pneumonia. Tyler was then the first vice president to become president due to the death of his predecessor, serving from 1841-1845.

Tyler also has the distinction of becoming the first president to get married while in office ? after his first wife died in 1842, Tyler married Julia Gardiner, who was 30 years younger than him, in 1844.

Android Smartphone Round-Up: December/January Edition

groupshotWe took a break from the Android round-up in December because, well, to be honest I was on vacation. But January gave us a few extra smartphones and the holidays are over, so we're back. What we've got for you today leans into more expensive turf, and unfortunately, our favorite Android devices for the past two months are also exclusively at Verizon, so Big Red subscribers should pay attention. Without further ado, these are our favorite December/January releases of the Android persuasion: The Samsung Galaxy Nexus, the LG Spectrum, and the Motorola Droid RAZR Maxx. Enjoy!

US official: SEAL team in rescue also killed Osama

(AP) ? A U.S. official says the Navy SEAL team that rescued two hostages in Somalia was the same unit that killed Osama bin Laden.

SEAL Team Six parachuted into Somalia under cover of darkness Wednesday and rescued an American woman and a Danish man from an outdoor camp where they were being held by Somali pirates, the official said.

The same team executed the mission last May in which al-Qaida leader bin Laden was killed.

The U.S. official spoke on condition of anonymity to discuss the top secret operation.

MILAN (AP) -Thiago Motta's agent says the midfielder could play his last game for Inter Milan on Wednesday before a move to Paris Saint-Germain.

In an interview with Italian radio station Radio Crc, Motta's agent Dario Canovi says, "PSG asked if he would be interested and the lad said yes. Tonight could be Thiago Motta's last game in an Inter shirt."

Inter meets Napoli in the Italian Cup.

Motta arrived at Inter in 2009 and was a key member of the treble-winning squad. However, the Brazilian who plays for Italy is thought to be unhappy that Inter has not yet renewed his contract, which expires in 2013.

Gingrich: Romney self-deportation plan a fantasy (AP)

DORAL, Fla. ? Republican presidential candidate Newt Gingrich on Wednesday ridiculed rival Mitt Romney's call for self-deportation of illegal immigrants as an "Obama-level fantasy" that would be inhumane to long-established families living in America. Romney, for his part, accused Gingrich of pandering to a Hispanic audience and said Gingrich himself had supported self-deportation in the past.

Discussing immigration in state where 13 percent of registered voters are Hispanic, the former House speaker criticized Romney's immigration policy during a forum with the Spanish-language television network Univision, saying the idea of self-deportation would never work. Romney snapped back at him later in the day at the same forum.

During a debate earlier this week, Romney said he favors self-deportation over policies that would require the federal government to round up millions of illegal immigrants and send them back to their home countries. Advocates of Romney's approach argue that illegal immigration can be curbed by denying public benefits to them, prompting them to leave the United States on their own.

"You have to live in a world of Swiss bank accounts and Cayman Island accounts and automatically $20 million income for no work to have some fantasy this far from reality," Gingrich said, alluding to details in Romney's income tax returns made public Tuesday. "For Romney to believe that somebody's grandmother is going to be so cut off that she is going to self-deport, I mean this is an Obama-level fantasy."

But Gingrich's campaign has spoken of the self-deportation policy he ridiculed Wednesday.

"I recognize that it's very tempting to come out to an audience like this and pander to the audience," Romney said, pointing out that Gingrich has previously made comments supporting the idea of self-deportation. "I think that was a mistake on his part."

In debates, Gingrich has defended a proposal to allow some illegal immigrants to stay in the U.S. if they've lived here for more than 25 years and have a local sponsor.

Romney's campaign directed reporters to past comments by Gingrich spokesman R.C. Hammond, who said that only a small percent of illegal immigrants would likely be allowed to stay in the U.S. under Gingrich's plan. Hammond went on to say that the vast majority of them would likely "self-deport."

Gingrich also ran into trouble over a radio ad calling Romney "anti-immigrant." Florida Sen. Marco Rubio called the ad "inaccurate" and "inflammatory." Romney's campaign also asked Gingrich in a letter to pull the ad. Gingrich's campaign had no immediate comment on whether it would comply with the request to pull the ad. The Miami Herald reported that the campaign planned to remove the ad based on Rubio's comments.

Romney called the anti-immigrant label an "epithet" and "inappropriate."

At the forum, Gingrich spoke instead about other elements of his immigration plan, including controlling the border and establishing a guest-worker program to better manage the influx of immigrants. Gingrich said he favors a path to citizenship for illegal immigrant children who serve in the military but not for simply completing college.

Romney defended his opposition to allowing the children of illegal immigrants to pay in-state tuition at American universities. He said there are inexpensive options that will allow them to go to college.

Gingrich told Univision he believes states should charge in-state tuition rates for students who were born in the U.S. to illegal immigrant parents, but that he favors charging out-of-state tuition for children who were brought to this country illegally.

Texas Gov. Rick Perry's support of a Texas policy to allow children of illegal immigrants to pay in-state tuition proved to be problematic with conservatives nationwide. Perry dropped out of the race last week.

Gingrich began the interview by speaking a few halting phrases of welcome in Spanish ? "Buenos Dias estudiantes" ? but begged off when moderator Jorge Ramos pressed him to go further. Romney did not speak any Spanish during his interview.

Romney was asked about family members he has living in Mexico. Romney's father, George Romney, was born in Mexico but moved back to the U.S. as a young child.

Ramos asked Romney if he had a claim to being Mexican American.

"I don't think people would think I was being honest with them if I said I was Mexican American but I'd appreciate it if you'd get that word out," Romney said, smiling.

Florida is home to many Hispanics of Puerto Rican or Cuban descent who don't view immigration as a priority but are more interested in the issue than the general public.

After the interview, Romney railed against Fidel Castro's Cuba in a speech before several hundred Cuban-American democracy activists. Romney has significant support from the Cuban-American political establishment in Miami.

"It is time for us to strive for freedom in Cuba, and I will do so as president," he said. "We must be prepared to support the voices for democracy in Cuba."

While the interview questions asked of both candidates were mostly about Hispanic concerns, Ramos asked Gingrich whether it was hypocritical for him to criticize then-President Bill Clinton and pursue his impeachment in the 1990s when Gingrich was being unfaithful to his second wife.

Gingrich snapped at the premise of the question and said it was Clinton's false testimony under oath that bothered him the most.

"The fact is I've been through two divorces. I've been deposed both times under oath. Both times I told the truth in the deposition," Gingrich said. "I have never lied under oath. I have never committed perjury."

Ramos asked Romney to declare his wealth, to which Romney replied that he's worth between $150 million and "200-and-some-odd million dollars."

Fed likely to hint of no rate increase before 2014

(AP) ? It could be quite a while yet before the Federal Reserve starts raising the interest rates it's kept at record lows for three years.

Maybe not before 2014.

That's the thinking of many analysts as the Fed prepares this week to provide more explicit clues about how long short-term rates will likely stay near zero.

Starting when their policy meeting ends Wednesday, Fed members plan to forecast the direction of those rates four times a year. The clearer guidance will accompany the Fed's usual quarterly predictions of growth, unemployment and inflation.

The new hints about rates are part of a Fed drive to make its communications with the public more transparent. The more immediate goal is to assure consumers and investors that they'll be able to borrow cheaply well into the future.

No announcements are expected Wednesday of any further Fed action to try to lift the economy. Most analysts think Fed members want to put off any new steps, such as more bond purchases, to see if the economy can extend the gains it's made in recent months.

That's true even though this year's new roster of voting members on the Fed's policy panel suggests that fewer voters would likely oppose further steps to boost the economy. Twice last year, Fed action to try to further lower long-term rates drew three dissenting votes out of 10.

Instead, expectations are focused on the likelihood that the Fed's first quarterly forecast of interest rates will signal no rate increase is probable until at least 2014. That would mark a shift. Since August, the Fed has said in policy statements that it planned to keep its benchmark rate at a record low until at least mid-2013, as long as the economy remained weak.

Here's why analysts expect the Fed to signal that most members see no increase before 2014:

On Wednesday, the Fed will use two charts to signify the thinking of each of its 17 policy committee members about rates.

One chart will illustrate how high each committee member thinks the Fed's benchmark rate will be at the end of 2012, 2013 and 2014.

A second chart will show how many members think the first rate increase will occur in each year from 2012 through 2016.

The charts won't identify any member by name.

Because the range of options extends as far as 2016, many analysts think the consensus view within the Fed is to avoid any rate increase before 2014 ? the average of the possible options.

"Just seeing that the choice of a year for the first hike in the Fed funds rate goes all the way out to 2016 makes us think there are at least a few members of the committee who don't want to raise rates until the unemployment rate gets back down to 5 percent or 6 percent," said Chris Rupkey, chief financial economist at Bank of Tokyo-Mitsubishi.

"We guess there will be some hawks looking for a hike in 2013 and some doves thinking more like 2015," Rupkey said. "The weighted average is likely to be 2014."

Ward McCarthy, chief financial economist at Jeffries & Co. Inc., said he thinks the Fed's guidance will hint that the first rate increase could come in early 2014.

Others, such as economists at RBC Capital Markets, think the forecasts will suggest no change until late 2014.

A further clue to the Fed's plans will come in its economic projections. In its last projections in November, the Fed forecast that the economy would grow between 2.5 percent and 2.9 percent in 2012. That figure exceeds the forecasts of many private economists. Should the Fed reduce its expectations for growth, that could signal that it's prepared to do more for the economy.

The Fed has already taken numerous unorthodox steps to try to strengthen the economy. Since 2008, for example, it's kept its key rate, the federal funds rate, at a record low between zero and 0.25 percent. It's also bought government bonds and mortgage-backed securities to try to cut long-term rates and ease borrowing costs.

The idea behind the Fed's two rounds of bond buying was to drive down rates to embolden consumers and businesses to borrow and spend more. Lower yields on bonds also encourage investors to shift money into stocks, which can boost wealth and spur more spending.

Some Fed officials have resisted further bond buying for fear it would raise the risk of high inflation later. And many doubt it would help much since Treasury yields are already near historic lows. But Bernanke and other members have left the door open to further action if they think the economy needs it.

The path to such a move could be easier because three regional Fed bank presidents who dissented last year from further Fed action are no longer voting members of the committee. They're being replaced by three who are seen as more likely to back additional efforts to aid the economy.

Vincent Reinhart, a former Fed economist who is chief U.S. economist at Morgan Stanley, says he thinks the Fed will launch another round of bond buying in the spring. That's because he thinks the economy will slow in the current January-March quarter compared with the final months of 2011.

Some think the Fed is most likely to buy more mortgage-backed securities. Doing so could help further reduce record-low mortgage rates and help boost home sales. The weak housing market has held back the economy.

Brian Bethune, an economics professor at Dartmouth College, expects another round of bond purchases in the second half of the year. Bethune thinks the Fed will use those purchases to counter the economic drag that could result if government spending cuts start next January. Those cuts are to take effect unless Congress resolves an impasse on extending tax cuts first passed during the Bush administration.

In addition to providing more guidance on rates, the Fed is weighing other changes in its communications. One could be a new statement to clarify its long-term targets for inflation and unemployment.

The Fed's inflation goal is thought to be between 1.7 percent and 2 percent. Its long-run goal for unemployment is believed to be roughly between 5 percent and 6 percent.

Some private economists say the Fed would start a new bond-buying program only after it resolves an internal debate on its communications strategy ? which could happen as soon as this week.

"They want to get the communications changes out there and get them understood before they do anything else," said Alan Levenson, chief economist at investment firm T. Rowe Price.

SoundCloud passes 10 million user milestone, faces legal issues ...

SoundCloud has reached the next level as streaming service SoundCloud has passed the 10 million user mark. It has experienced rapid growth since SoundCloud was able to double its user base from 5 million in July 2011, to 10 million in January 2012. Honoring this success, the site launched a new Instagram-powered feature, called Story Wheel, which enables users to add words to their pictures.

Co-founder Alexander Ljung said in a statement:

When Eric (Wahlforss) and I started SoundCloud, we had the vision of enabling people to create and share sound more easily and collaboratively. Today 10 million people are recognizing that vision and it makes us extremely proud and encouraged that people are supporting our mission to unmute the web.

However, SoundCloud could also face legal issues since file-sharing sites MegaUpload or Grooveshark have been respectively shut down or charged copyright infringement. TechCrunch has listed SoundCloud amongst sites that could soon be in the firing line of the U.S. government. It remains to see if or how the service be affected by legal measures.

New Zealand authorities shut down 'Occupy' camps (AP)

AUCKLAND, New Zealand ? Authorities have effectively shut down the Occupy movement in New Zealand's largest city after more than 100 days of protest.

Auckland Council officers and police Monday confiscated cars, tents and camping gear from more than 50 protesters at four sites in Auckland. The raid came after a local court ruled authorities could remove property from people who were illegally camping.

Police arrested three people in Aotea Square during the raids.

Occupy encampments remain in other New Zealand cities. Protesters in this country joined the movement that began last September in New York as a protest against social and financial inequality.

Auckland Council spokesman Glyn Walters said protesters can return to the sites but are no longer allowed to camp there.

Man gets life for millionaire's murder in fraud scheme (Reuters)

SAN DIEGO (Reuters) ? A judge sentenced a former financial adviser to life in prison without parole on Friday for strangling a wealthy Southern California biotech executive and attempting to steal nearly $9 million from one of his investment accounts.

A San Diego Superior Court jury convicted Kent Keigwin, 61, of first-degree murder with special circumstances in November for the June 2010 death of 65-year-old John Watson.

Watson, a British-born millionaire who since his death has been praised for helping San Diego entrepreneurs win investments, was the former CEO and president of California-based biotechnology company Ionian Technologies Inc.

Keigwin, who was a financial adviser, was convicted of strangling Watson in the wealthy La Jolla beach enclave near San Diego, and subsequently transferred $8.9 million out of one of his accounts.

Keigwin had earlier worked to befriend Watson and later began tracking him and assuming his identity to defraud him, San Diego Deputy District Attorney Sharla Evert told Reuters.

On the day he killed Watson, Keigwin used a Taser to jolt him with an electric shock at the front door of his apartment in La Jolla and then strangled him, according to Evert.

Keigwin's DNA was subsequently found under the victim's fingernails, suggesting a struggle, Evert said.

Keigwin's attorney, Stacy Gulley, had said that Watson died after an "all-out fight" with Keigwin, who Gulley described as having had no motive to kill Watson.

But the day after Watson's death, Keigwin transferred $8.9 million from one of Watson's investment accounts into a new account he had opened in Watson's name, prosecutors said.

Keigwin had set up his first e-mail account in Watson's name over a year before the killing, and spent months setting up bank and investment accounts with the goal of siphoning off Watson's legitimate accounts, Evert said.

Homicide investigators arrested Keigwin three days after the murder, when he let himself into Watson's home using the dead man's keys and dressed in black with a backpack, Evert said. He may have been trying to clean up the crime scene, she said.

Keigwin, convicted of murder, was also found guilty of using the personal identity of another, burglary, forgery and attempted grand theft.

When he died, Watson was a board member with investor group Tech Coast Angels, which funds and guides fledgling companies with high growth potential in Southern California. Watson first came to the United States from Britain as a Fulbright scholar at Indiana University.

"He was great friends with our staff and often brought them roses, which they cherish now," Tech Coast Angel board member Stephen Flaim said.

Earlier this month, Tech Coast Angels said it had established the John G. Watson Foundation with a $1 million gift from his family to support entrepreneurs in the San Diego area.

The group described Watson as a shrewd investor who liked to hike and swim in the ocean.
